On May 28 Amnesty International issued its 2008 annual report in which achapter referring to the human rights violations committed by the United StatesGovernment included the case of René González, Gerardo Hernández, FernandoGonzález, Ramón Labañino and Antonio Guerrero, who for ten years have beenserving sentences totaling four life imprisonments plus 77 years. Vamos a resistir hasta que se haga justicia
Al conocer la decisión de la Corte de Apelaciones de Atlanta que le ratifica la sentencia de dos cadenas perpetuas más 15 años, nuestro compañero Gerardo Hernández se comunicó telefónicamente con Alicia Jrapko y este es el mensaje transmitido por la activista:Me acaba de llamar Gerardo, ya conocía sobre la decisión de la corte. Me dijo que no lo había sorprendido, que este es el mismo sistema de justicia que tiene encarcelado por más de 20 años a Mumia, a Leonard Peltier, y a los presos políticos puertorriqueños. "Nos echaremos los años que hagan falta, 30, 40, lo que sea, que mientras quede uno de ustedes afuera resistiendo nosotros también vamos a resistir hasta que se haga justicia." Me dijo que a todos los que preguntaran por él les dijera que él está bien, con mucha fuerza y siempre pa’lante.
Es necesario tener en cuenta los siguientes aspectos:
1. la decisión fue unánime, solo en lo relativo al Cargo 3 hay una opinión disidente de la jueza Kravitch
2. Gerardo no está entre los incluidos a la revisión de sentencia, los enviados al tribunal de Miami son Fernando, Antonio y Ramón. Gerardo estaría incluido sino tuviera una perpetua adicional, el panel aclaró que no se molestaba en ello puesto que no sería beneficiado aunque tuviese una rebaja.
3. no es exacto decir que el panel de Atlanta consideró excesivas las sentencias impuestas a los 3 que remite a Miami, mas bien dijeron que lo impuesto no se ajustaba a las normas
4. quien redactó la opinión a nombre de los tres jueces fue Pryor, a este juez lo designó la Corte cuando la decisión en banc. Pryor logró convertirse en juez gracias a McCain, quien desde el Senado consiguió un acuerdo para lograr que de los 12 jueces nombrados por Bush y no aprobados por el Senado finalmente se aceptaran a 3, entre los que estaba él.

Two Judges on Three-Judge Panel Uphold Conspiracy to Commit MurderConviction Despite Government's Lack of EvidenceNew York. The National Lawyers Guild (NLG) believes that politics influencedyesterday's federal appeals court decision upholding the convictions of fiveCuban patriots accused of spying in the United States. The so-called CubanFive were gathering information on U.S.-based exile groups planningterrorist actions against their island nation.The court did, however, vacate the sentences of three of the Five, includingtwo serving life terms. A three-judge panel of the 11th U.S. Circuit Courtof Appeals returned the three cases to a federal judge in Miami forre-sentencing based on findings that the three men had gathered noclassified information.The full 11th Circuit court in August 2006 upheld the convictions of theFive: Gerardo Hernández , Fernando González , René González , RamonLabañino, and Antonio Guerrero. It rejected claims that their federal trialshould have been moved out of Miami because widespread opposition to theCuban government among Cuban-Americans would make it impossible to get afair and impartial jury.In the appeal ruled on yesterday, the Five challenged rulings on thesuppression of evidence from searches conducted under the ForeignIntelligence Surveillance Act, sovereign immunity, discovery procedures,jury selection, prosecutorial and witness misconduct, jury instructions,sufficiency of the evidence to support their convictions, and sentencing.In this latest decision, the panel voted 2-1 to affirm the life sentence forGerardo Hernández, who was convicted of conspiracy to commit murder in thedeaths of four Miami-based pilots shot down by Cuban jets in 1996. In her16-page dissent, Judge Phyllis Kravich wrote that the government failed topresent evidence sufficient to prove beyond a reasonable doubt thatHernández agreed to participate in a conspiracy to shoot down planes overinternational airspace, resulting in the deaths of four pilots from ananti-Castro organization, Brothers to the Rescue. The panel also affirmedRene González's 15-year sentence for acting as a non-registered foreignagent and conspiracy to act as a non- registered foreign agent.The panel vacated the life terms of Labañino and Guerrero, agreeing withtheir contentions that their sentences were improperly configured because no"top secret information was gathered or transmitted. " The judges alsovacated Fernando González's 19-year sentence because he was not a manager orsupervisor of the network. The panel remanded these cases to the districtcourt for re-sentencing.After a trial that lasted six months, the Five were convicted in 2001 ofacting as unregistered Cuban agents in the United States and of conspiracyto commit espionage for attempting to penetrate U.S. military bases. Athree-judge panel of the 11th Circuit overturned the convictions in 2005,saying there should have been a change of venue. But the full court reversedthat decision, 10-2."Conspiracy has always been the charge used by the prosecution in politicalcases," said NLG attorney Leonard Weinglass, who represents Guerrero. "Inthe case of the Five, the Miami jury was asked to find that there was anagreement to commit espionage. The government never had to prove thatespionage actually happened. It could not have proven that espionageoccurred. None of the Five sought or possessed any top secret information orUS national defense secrets," Weinglass added. "The sentence for theconspiracy charge is the same as if espionage were actually committed andproven. That is how three got life sentences. The major charges in this casewere all conspiracy related, the most serious being conspiracy to commitmurder levied against Gerardo Hernández.""Anti-Cuba sentiment has tainted all possibility of a fair trial for theFive since their original arrest and confinement, which the UN Rapporteur onTorture described as violating the Convention Against Torture and Cruel,Inhuman or Degrading Treatment or Punishment," said NLG Executive DirectorHeidi Boghosian. "During the original trial, the Bush administration paidjournalists to write unfavorable stories about Cuba. Comunicado público ante el fallo del Tribunal de Apelaciones del Onceno Circuito sobre los Cinco Manifestación en Madrid exigiendo la libertad de los Cinco El Comité de Madrid por la libertad de los Cinco cubanos presos en EEUU hace público su más profundo rechazo ante la insólita decisión emitida por el Panel de tres jueces del Tribunal de Apelaciones del onceno Circuito, en la cual hace público su fallo denegando los recursos de la apelación de la defensa de los Cinco Este fallo emitido en la tarde de ayer, 4 de junio de 2008, confirma todos los cargos de los que se les había encontrado culpables en su juicio original, incluyendo los cargos de conspiración para cometer espionaje y el cargo de conspiración para cometer asesinato. Las condenas de cadena perpetua han sido reenviadas al Tribunal de Distrito en Miami que originalmente los juzgó, para que se les reduzca. Este fallo se aleja diametralmente de los expresados por diferentes organismos internacionales como La Opinión No. 19/2005 del Grupo de Trabajo sobre Detenciones Arbitrarias de Naciones Unidas. Otras de organizaciones de Derechos Humanos como Amnistia Internacional que en su informe anual, emitido el 28 de Mayo de 2008, en su capítulo dedicado a la violación de los DDHH cometidos por el Gobierno de los EEUU se incluye el caso de los Cinco (PAG. 172).Del mismo modo no tiene en cuenta la petición de libertad reclamada por miles de personalidades del mundo, incluyendo premios nobeles, Uniones de Juristas y prestigiosas Asociaciones de Abogados, incluso de EEUU. Tampoco a la inmensa red de solidaridad desplegada por todo el mundo con esta causa.Hasta donde se ha podido comprobar, la única culpa de los Cinco fue la de proteger la seguridad de la Patria, e incluso de los EE.UU. y del mundo, de las acciones terroristas cometidas por los grupos armados y las organizaciones contrarrevolucionarias anticubanas con base en Miami. Desde hace 49 años miles de cubanos han muerto como consecuencia de los repudiables actos terroristas.La credibilidad del estado de derecho y su separación de poderes se pone cada vez más en entredicho en los EEUU. Este fallo hace más evidente que lo que se juzga es políticamente a la Revolución cubana y a la firme decisión de su pueblo de no doblegarse ante el imperialismo.La espuria guerra contra el terrorismo que el gobierno de EEUU dice librar, protege a connotados terroristas que se exhiben en público y lanzan sus proclamas contra Cuba. Este es el caso del criminal Luís Posada Carriles, autor entre otros innumerables crímenes del atentado al avión civil de Cubana de Aviación el 6 de octubre de 1976 donde perecieron sus 73 ocupantes. UN food summit accord held up over Cuban concerns
By FRANCES D'EMILIO – ROME (AP) — Delegates in the closing hours of a three-day U.N. summit were trying to agree Thursday on a final document on how to tackle growing hunger and civil unrest sparked by skyrocketing prices of food and fuel.But Cuba and some other Latin American countries were insisting on language condemning embargoes, said Nick Parsons, a spokesman for the Rome-based U.N. Food and Agriculture Organization, which is hosting the summit.The United States, a huge aid donor, opposes efforts to condemn its long-running embargo against the communist-run island. The U.S. delegation refused comment on the embargo snag because the closed-door negotiations were in progress.At least one delegate said there was much effort to overcome the embargo snag."I think we must not confuse the goal of this summit with political goals," said Alberto Lopez, a member of the Spanish delegation."We are looking for an agreement to solve the dramatic situation" of widening hunger in the world, Lopez told The Associated Press. "We cannot have political declarations coming at the advantage of a single nation."Parsons said another sticking point in the talks going into Thursday involved some French reservations over language calling for world trade talk progress. U.N. Secretary-General Ban Ki-moon opened the summit on Tuesday by urging nations to reduce trade restrictions such as export limits and import tariffs.A final draft of the summit declaration that was being haggled over Thursday calls for stepped up food production, reduced trade restrictions and more research on the contentious issue of biofuels.A copy of the draft obtained by The Associated Press ends with a pledge to alleviate the suffering caused by the crisis, to stimulate food production, to increase investment in agriculture, to address obstacles to food access and to use the planet's resources in a sustainable way.The declaration of resolve to "address obstacles to food access" could be taken to refer to, among other restrictive measures, embargoes.Previous food summits in Rome dating back to the last decade have also seen Cuba press for condemnation of the embargo.The draft sought a balance between contrasting positions on biofuels that were highlighted during the summit. It said it was "essential" to address the "challenges and opportunities" posed by biofuels."In-depth studies are necessary to ensure that production and use of biofuels is sustainable," it said.Fuels made from sugar cane, corn and other crops have been seen as a way to combat climate change and rising oil prices. The United States has been heavily subsidizing corn-based ethanol production. Last year, the 27-nation European Union endorsed a plan calling for biofuels to make up 10 percent of the fuel for road vehicles by 2020.But environmentalists, international groups and some countries are becoming increasingly wary of biofuels, which they say could accelerate global warming by encouraging deforestation — and contribute heavily to the commodities price hike by diverting production from food crops to biofuel crops.The draft calls on the international community to continue efforts "in liberalizing international trade in agriculture by reducing trade barriers and market-distorting policies."The document also echoes Ban's call to increase food production by 50 percent by 2030 to meet rising demand.Ban predicted that as much as $20 billion may be needed each year to increase food production.

El proyecto de declaración final de la cumbre sobre seguridad alimentaria de la FAO, que se celebra en Roma, ha sido aprobado hoy por el Plenario, después de horas de discusiones que hacían temer que no se llegaría a un acuerdo. La declaración cuenta con la objeción de Argentina y las duras críticas de Venezuela y Cuba, que consideran que el documento no incluye medidas reales para acabar con el hambre en el mundo.Los delegados de 183 países que participan del encuentro de la FAO han publicado la declaración que busca "erradicar el hambre y garantizar los alimentos para todos". Pero las discrepancias sobre las barreras comerciales y asuntos geopolíticos habían generado dudas de que se alcanzara un consenso.A las críticas de las delegaciones cubanas y venezolanas se han unido las de Ecuador, Nicaragua y Bolivia, después de lo cual el presidente del Plenario cortó la palabra a las delegaciones. Cuba ’s First Vice President met with Vatican Secretary of State In Rome
HAVANA, Cuba, June 5 (acn) Cuba’s First Vice President Jose Ramon Machado Ventura met on Wednesday with the Vatican’s Secretary of State, Cardinal Tarcisio Bertone, as part of his working agenda in Rome, where he is attending the Summit on Food Security. During the meeting, Machado Ventura and Cardinal Bertone expressed their satisfaction for the results of the trip of the representative of Pope Benedict XVI to the island in February, its positive repercussion, and their willingness that bilateral relations continue to develop in the same direction. In statements to reporters in Rome, the Cuban first vice-president pointed out that Cuba considers that the Summit on Food Security has the virtue of revealing the seriousness of problems like famine and climate change.Machado Ventura highlighted the speeches delivered by representatives of developing countries about the food crisis. The Spanish news agency EFE said that the delegations of countries participating in the Summit on Food Security in Rome continued their debates on the Final Declaration on Wednesday and on the global plan of action to counter the crisis, which has stemmed from increasing food prices. Meanwhile, the Italian news agency ANSA pointed out that Latin American delegations made an appeal for the elimination of protectionism and agriculture subsidies, while at the same time they warned that the increase of food prices could generate social and political tensions on the planet.

'Che' brand irks Guevara's children
By ANDREA RODRIGUEZ –HAVANA (AP) — Two of Ernesto "Che" Guevara's children said Thursday they were tired of seeing their father's image used to sell everything from T-shirts to vodka, calling the growth of the revolutionary as a global super-brand "embarrassing."Aleida Guevara, the eldest of Guevara's four children by his second wife, Cuban revolutionary Aleida March, said the commercialization of her father's image contributed to tension between rich and poor in some countries."Something that bothers me now is the appropriation of the figure of Che that has been used to make enemies from different classes. It's embarrassing," she wrote during an Internet forum sponsored by Cuba's government ahead of what would have been her father's 80th birthday on June 14.Born to a well-to-do family in Argentina in 1928, Guevara helped Fidel Castro overthrow Cuban dictator Fulgencio Batista in 1959. But he was executed in 1967 while trying to foment a similar revolution in Bolivia.He has since become a pop icon, considered a symbol of rebellion even 40 years after his death, thanks to an iconic 1960 portrait by Cuban photographer Alberto Korda. Variations of the image, featuring Guevara with a defiant stare and starred beret, can now be found the world over, on T-shirts, posters, coffee mugs and refrigerator magnets.Guevara's children took Internet queries for two hours, fielding questions from users in Qatar, Argentina and Brazil, as well as Cuba, where both live.Aleida Guevara was asked about the use of her father's image to sell British vodka and French soft drinks. She decried those campaigns as well one in Switzerland that uses his likeness to peddle cell phones."We don't want money, we demand respect," wrote Guevara, who is a trained physician like her father.Cuba erected a bronze statue of Guevara in the city of Santa Clara, site of his key military victory on New Year's Eve 1958, which helped prompt Batista to flee the island and usher Castro into power.A towering likeness of him also adorns Havana's Revolution Plaza and his picture and quotations are found on billboards across the country.But Cuba's communist government also has worked hard to make money off of the revolutionary's image, stocking tourist shops with T-shirts, postcards and other trinkets bearing his face and three-letter signature.Despite that, Guevara's son Camilo said he supported Fidel's younger brother Raul, who succeeded him as president in February.The younger Castro waited 49 years to become Cuba's leader, and Guevara said "it would be stupid not to take advantage of all that experience.""The vote of any citizen is secret, (but) I'll make mine public: YES FOR RAUL," Guevara wrote.Actor Benicio Del Toro recently won best actor at the Cannes Film Festival for his portrayal of Guevara in Steven Soderbergh's 4 1/2 hour "Che." A punto de cumplirse el 80 aniversario de su nacimiento los hijos del legendario guerrillero Ernesto Che Guevara luchan por que la imagen de su padre no sea usada para "vender" y para que su legado a la revolución cubana siga vivo. "Algo (que) me molesta en la actualidad es la apropiación de la figura del Che que han tratado de hacer sus enemigos de clases, es vergonzoso", reflexionó Aleida Guevara en un foro de internet dedicado a la memoria de su padre. Protestó porque la joven mirada de su progenitor, su rostro y su melena rebelde suele ser usadas como publicidad de telefonía móvil en Suiza o de un vodka en Inglaterra hasta refrescos en Francia. A comienzo de esta década el fotógrafo Alberto Korda, que tomó la foto del rostro del Che con su boina que ha sido símbolo revolucionario en el mundo, ganó un pleito a la empresa Smirnoff que puso la popular imagen de Guevara en anuncios de vodka. "No queremos dinero, exigimos respeto", se quejó Aleida, médica como su padre y quien indicó que las leyes en cada país entorpecen las gestiones. Nacido en 14 de junio de 1928 en Rosario, Argentina, el Che se sumó a finales de los 50 a Fidel y Raúl Castro en una guerrilla con la cual triunfaron en Cuba y cuya impronta se sintió en todo el tercer mundo, especialmente en América Latina. "Que la industria de Hollywood haga versiones de su vida, siempre y cuando sean objetivas y cercanas a la realidad, creo que es positivo", comentó Camilo Guevara. "Puedes entretenerte viendo su historia o conociendo su vida y a la vez transformarte", agregó. Ambos hijos del comandante guerrillero son cubanos. Como ejemplo del legado de su padre, Camilo Guevara destacó el carácter "internacionalista" de la revolución cubana y su disposición a enviar médicos y maestros a otros pueblos necesitados. Cuba urged to embrace globalisation

The Cuban tourism industry would be best served by marketing itself to a global audience, according to the World Travel and Tourism Council (WTTC).Cuba has recently seen improvements in its domestic economic conditions and is seen in some quarters as a destination for the future.According to figures from the WTTC, the contribution of the travel and tourism economy to employment in Cuba is set to rise from 489,000 jobs this year to 562,000 jobs in 2018.Amir Girgis, an economist with the WTTC, said that Cuba should ensure that this growth materialises by marketing itself on a global level.'We highly recommend that Cuba, as a destination, targets the entire global market rather than focusing on specific markets,' he said.'The rise of emerging markets creates a new source of travellers as well as travel destinations. Cuba should thus embrace globalisation and use it to [its] advantage.'According to figures from the ministry of tourism, the Cuban travel industry passed the milestone of 1m visitors 22 days earlier this year than in 2007.
